These Terms govern access to process_safety.ai and the Cause Map tool (the “Service”). By using the Service, you agree to these Terms. If you use it for an organization, you confirm that you are authorized to accept these Terms for that organization.
Important safety limitation: the Service is a documentation and workflow aid. It is not a substitute for a qualified process-safety professional, engineering judgment, field verification, a complete investigation, or a HAZOP, LOPA, PHA, or other analysis required by law or your organization.
1. Eligibility and professional use
You must be at least 18 years old and legally able to enter into these Terms. The Service is intended for professional and organizational use. You are responsible for ensuring that your use is permitted by your employer, client, contracts, and applicable law.
2. Current Service
The current public Service provides a browser-based Cause Map with problem-outline, map, timeline, process-map, solutions, evidence attachment, JSON import/export, and optional local autosave features. It does not currently include user accounts, paid plans, or cloud storage for Cause Maps.
The Service is in an early stage. We may add, remove, suspend, limit, or change features, file formats, compatibility, or availability. Roadmap descriptions are plans, not commitments or guaranteed delivery dates.
3. Permission to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Service for lawful internal business and professional purposes. This permission does not transfer ownership of the Service or its design, code, branding, or documentation.
You may download and use the Cause Map JSON files you create. You may not copy, resell, sublicense, or commercially exploit the Service itself except under a separate written agreement.
4. Your content and files
You retain your rights in the content and files you create or load into the Cause Map (“User Content”). The current tool processes User Content locally and does not upload it to us. You grant us no license to local User Content merely by using the tool.
You are responsible for:
having the rights and permissions needed to use the User Content;
avoiding unlawful, infringing, malicious, or improperly disclosed information;
classifying information and following applicable company, client, privacy, export-control, records, and cybersecurity requirements;
protecting devices and exported files and maintaining appropriate backups; and
reviewing imported files and all outputs before relying on or sharing them.
Browser autosave and JSON export are convenience features, not managed records storage or a backup service. Clearing browser data, browser or device failures, storage limits, expiration, or user action can cause data loss. Exported files may include every embedded evidence attachment and are not encrypted by the Service.
5. Process-safety and regulatory disclaimer
The Service helps organize information. It does not determine root cause, establish causation, verify evidence, calculate risk, validate safeguards, perform independent protection layer analysis, provide engineering approval, or certify compliance. Any examples, starter content, labels, and suggested workflow are general information only.
You must use qualified personnel and appropriate procedures to:
verify facts, causal relationships, chronology, assumptions, calculations, and recommendations;
conduct site-specific hazard identification and risk assessment;
comply with OSHA, EPA, state, local, international, industry, company, and contractual requirements that apply to you;
control changes and preserve official records in authorized systems; and
make operational, emergency, legal, personnel, or investment decisions.
The Service is not an emergency system and must not be used to control a process, operate equipment, replace alarms or safeguards, or communicate time-critical emergency instructions. If there is an active emergency, follow your site emergency plan and contact the appropriate emergency services.
6. Acceptable use
You may not:
use the Service unlawfully or in a way that violates another person’s rights;
upload or import malware, intentionally malformed files, or content designed to disrupt the Service or another device;
probe, bypass, disable, or interfere with access controls, security protections, rate limits, or usage restrictions;
misrepresent Service output as independently verified, certified, or endorsed by us;
use automated means to overload, scrape, or extract the Service except as expressly permitted; or
reverse engineer the Service except to the limited extent a restriction is prohibited by law.
7. Third-party services
The website uses third-party providers for hosting, fonts, form processing, email, and product analytics. Their services may be governed by separate terms and may change or become unavailable. We are not responsible for third-party websites or services outside our control.
8. Feedback and communications
If you send product suggestions or feedback, you permit us to use it without restriction or compensation, while you retain ownership of any underlying materials you own. Do not send confidential information through public forms. We may contact you about a beta request or message you submitted. Future marketing messages will include any opt-out required by applicable law.
9. Our materials
The Service, branding, visual design, software, and site content are owned by us or our licensors and protected by applicable intellectual-property laws. All rights not expressly granted in these Terms are reserved. Third-party names and marks belong to their respective owners.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, data preservation, compatibility, and results.
We do not warrant that the Service will be uninterrupted, error-free, secure, complete, compliant with a particular standard, or suitable for a specific investigation or safety decision. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, revenue, business, goodwill, or opportunity; business interruption; or operational, environmental, property, personal-injury, or regulatory consequences arising from or related to the Service.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or US $100. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited.
12. Responsibility for misuse
To the extent permitted by law, you will defend, indemnify, and hold us harmless from third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, your User Content, or your material violation of these Terms. This section does not apply where prohibited by law.
13. Suspension and termination
You may stop using the Service at any time. We may restrict or suspend access when reasonably necessary to protect the Service, users, or others; respond to legal requirements; address misuse; or discontinue the Service. Because Cause Map data is local, you should export any needed backup before discontinuing use.
14. Future accounts and paid features
Accounts, subscriptions, cloud collaboration, payment processing, and other paid portions are not part of the current Service. If introduced, they may be governed by updated Terms, an order form, a data-processing agreement, service levels, billing and cancellation terms, or other additional terms presented before use.
15. Disputes
Please contact hello@process_safety.ai first so we can try to resolve a concern informally. Any unresolved dispute may be brought in a court with lawful jurisdiction, subject to applicable mandatory consumer or local law.
16. General terms
If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, sale, or transfer of the Service. These Terms and the documents they reference are the entire agreement about the current Service.
17. Changes and contact
We may update these Terms as the Service changes. We will post the revised Terms and update the effective date. Your continued use after the revised Terms take effect means you accept them to the extent permitted by law.
